How do I fill out the weekly claim if I am also receiving workers’ compensation benefits?

Workers’ Compensation provides wage replacement when you cannot work due to an on-the-job injury. These benefits are paid either by the Department of Labor & Industries (L&I) or by your employer’s private insurer.

It is unlawful to receive time-loss or wage-replacement benefits from Workers’ Compensation for the same week you receive Paid Leave. However, payments made for medical expenses (medical-only) from L&I are allowed while you are on Paid Leave.

Paid Leave benefits are issued weekly, while Workers’ Compensation benefits are paid twice per month. If you have a Workers’ Compensation claim:

  • Review the dates covered by each Workers’ Compensation payment.
  • When filing your Paid Leave weekly claim, you must report that you will receive Workers’ Compensation benefits any time the coverage dates overlap with your Paid Leave week, even if the overlap is only one day.
  • Because Workers’ Compensation payments often cover multiple weeks, a single payment may make you ineligible for two or three Paid Leave weeks.
